Terms & Conditions

This sets out the terms and conditions for the supply of goods, services and information on The Cottage Chocolatier and does not affect your statutory rights as a consumer. These Terms and Conditions, together with our current website prices, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the supply of the products to you by us. 

My contract with you

Once you have submitted and confirmed your order(s), I will acknowledge receipt of the order by sending you an email to the email address you have provided. This acknowledgement does not confirm my acceptance of your offer to purchase. After confirming receipt of your order, I will check that the relevant products are in stock. A contract for the sale of Products between you and The Cottage Chocolatier will only be formed when I confirm that the chocolates have been dispatched.

If I cancel your order, I will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. 

If I have made a mistake in your order - wrong product, wrong quantity, your products arrived damaged or not at all. 

My obligation will be: 

  • Replace damaged goods or give you a refund

  • Send you out additional products if the quantity is wrong

  • Resend the order again if you haven't received your products

I will not be obliged to offer any additional compensation for disappointment suffered.

 

Price

The prices payable for products that you order are as set out in my website. These prices may vary.

 

Deliveries 

I currently offer delivery via The Royal Mail as follows:-

Tracked 24 (24 hour next working day). Please note Royal Mail aims to deliver the next working day, however, it can take up to 2 working days.

Signed for First Class (24 hour next working day). Please note Royal Mail aims to deliver the next working day, however, it can take up to 2 working days. A signature is required on delivery.

Special Delivery Guaranteed 9am-1pm Monday to Friday (24 hour next working day). Saturday delivery is not guaranteed next day. Compensation cover up to £750.

I will deliver the products ordered by you to the address you give me for delivery at the time you make your order. It is, however, your responsibility to provide me with accurate delivery address details. I will not check or verify addresses and messages supplied by you.

You will become the owner of the products you have ordered when they have been delivered to the address you have supplied. Once products have been delivered, they will be held at your own risk and my contract is to be deemed complete.

 

Delivery only in the UK

It is your responsibility to ensure that an appropriate person is available to receive the order at the delivery address at the time of delivery. If no-one is available, it is your responsibility to re-arrange delivery with the courier where appropriate. If no-one is available to receive the order, the courier may attempt to leave the goods in a safe place or with a neighbour. This is at the discretion of the courier, and The Cottage Chocolatier cannot be held liable for any loss or damages which occur after delivery has been made.

Should you fail to be present to receive your delivery, I reserve the right to charge you for the full amount for any goods which are returned to us by the courier, and for the cost of delivery.

 

Temperature 

I cannot be held responsible for heat damage to products and/or packaging in transit. I avoid sending parcels when they may be held in a third-party warehouse for longer than is necessary.

 

Liability 

Any complaint for loss, damage or defects must be reported to me within 24 hours of delivery. If you notify a problem to me under this clause, my maximum liability will be limited to the replacement of, or refund for cost of these goods.

Save as precluded by law, I will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to me under this condition and I shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the products in question as above.

 

Invalidity 

If any part of these Terms and Conditions is unenforceable (including any provision in which I exclude my liability to you) the enforceability of any other part of these conditions will not be affected.

 

Governing Law 

Contracts for the purchase of goods or services through the Site shall be governed by English law. Any dispute arising from, or related to, such contracts shall be subject to the exclusive jurisdiction of the courts of England.
